Terms of Use

These Terms of Use ("Terms") form a binding legal agreement between you and Event Kabaadi Private Limited ("Event Kabaadi", "we", "us" or "our"). They govern your access to and use of our website at eventkabaadi.com, our Android and iOS mobile applications and any related services (collectively, the "Platform"). Please read these Terms carefully. By accessing the Platform, browsing as a guest, creating an account, posting a listing or otherwise using any feature, you agree to be bound by these Terms. If you access or use the Platform on behalf of a business or any entity, you represent that you have authority to bind that entity, and your actions shall bind the said entity.

These Terms incorporate by reference our Privacy Policy and any specific terms displayed on the Platform.

If you do not agree, you must not access or use the Platform.

1. About the Platform

Event Kabaadi operates as a listing platform dedicated to the buying, selling, renting and exchange of pre-owned, surplus or unused event-related goods, including but not limited to decor, props, furniture, lighting equipment, signage, sound and stage gear, and similar items.

The Platform operates on a hybrid model:

User-Listed Inventory: independent users post listings, set their own prices and transact directly with buyers. For these listings, Event Kabaadi is an "intermediary" within the meaning of Section 2(1)(w) of the Information Technology Act, 2000.
Managed Inventory: certain items are sourced, owned and resold by Event Kabaadi directly. These listings are clearly marked as "Sold by Event Kabaadi" or similar designation, and for these items we act as the seller of record.

Where a listing is user-posted, Event Kabaadi is not a party to the underlying transaction and does not take title to, store, inspect, warrant or insure the items. We do not currently process payments through the Platform; buyers and sellers transact directly, offline. As a result, Event Kabaadi shall not have any control regarding such transactions nor guarantee the authenticity or suitability of the items, and shall bear no liability regarding the same.

2. Eligibility and Account Registration

You must be at least eighteen (18) years old and competent to enter into a contract under the Indian Contract Act, 1872.
Account creation requires verification of an Indian mobile number through a one-time password (OTP). You are responsible for keeping your mobile number, account credentials and device secure; we treat any action taken from your account as your action. You must provide accurate information while creating the account, and update if there are any changes in the future.
Guest browsing is permitted without an account, but you must create an account to post a listing, message a seller or transact through a managed-resale listing.
You must not create more than one account per mobile number, impersonate another person, or share or sell your account credentials. You must not use another person's mobile number, payment instrument, device or account without lawful authority.
We may suspend or terminate an account where we have reasonable grounds to believe these Terms have been breached, or we may refuse account creation where verification fails, or where required by law.

3. Listings and Seller Obligations

3.1 General requirements

Every listing must relate to a genuine, legally owned item that you have the right, title or authority to sell, rent or exchange free from any restrictions.
Listings must accurately describe the item, its condition, dimensions, any defects, and the asking price. Photographs must be of the actual item and must not be misleading, digitally altered or stock images presented as actuals.
You must respond to legitimate buyer enquiries within a reasonable time and honour the price and terms stated in the listing, subject to good-faith negotiation. You must also promptly mark items as sold, rented or unavailable on the Platform.
You are solely responsible for ensuring that the item listed complies with all applicable laws and regulatory requirements, including but not limited to, licensing, consumer protection and product safety.
You agree to accompany the listing with full disclosure of information relevant to the item and for facilitating the transaction, such as contact details, location, warranty, guarantee, refunds, exchanges etc.
You agree to provide any information that may be requested by us from time to time in relation to the listing; failure to do so may result in removal of the listing.
You are solely responsible for any taxes, duties, fees or compliance obligations arising from your transactions, including under the Goods and Services Tax laws where applicable.

3.2 Prohibited items and content

You may not list, request or facilitate the sale/rental of:

Counterfeit, stolen or misappropriated goods, or items that infringe third-party intellectual property rights.
Weapons, firearms, ammunition, explosives, fireworks (other than those permitted under applicable law for legitimate event use), or any item whose sale is restricted under the Arms Act, 1959 or the Explosives Act, 1884.
Alcohol, tobacco, narcotic drugs or psychotropic substances.
Hazardous, flammable, toxic or radioactive materials.
Live animals, animal parts protected under the Wildlife (Protection) Act, 1972, or any product made from protected species.
Items containing personally identifiable information of third parties (including event guest lists, attendee databases or photographs of identifiable individuals without consent).
Pirated audio, video, software or any other content that infringes copyright.
Adult or sexually explicit content, or content that is obscene, defamatory, hateful, harassing or that endangers public order.
Goods whose sale or possession is prohibited or restricted by Indian law, or by the law of the buyer's location.
Items recalled by the manufacturer or a regulatory authority for safety reasons.
Items that are grossly harmful, harassing, blasphemous, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner.
Items that harm minors in any way.
Items that contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
Items that threaten the unity, integrity, defence, security or sovereignty of India or public order.

Event Kabaadi reserves the right to remove or refuse any listing, restrict its visibility, require edits, warn users, suspend accounts or notify authorities, in its sole discretion, with or without notice to you.

4. Buyer Obligations

Inspect the item, verify its condition, safety and suitability for intended use and confirm the seller's identity before paying or taking delivery. You must not rely solely on photographs and descriptions on the Platform; all final purchase, rental or exchange is made at your own risk.
Comply with all applicable laws when contacting sellers, including anti-spam and harassment laws.
Do not use the Platform to send unsolicited commercial communications or to scrape, copy or aggregate listings.
Where you transact for a managed-resale item, you agree to the additional sale terms displayed on that listing at the time of purchase.

5. Communications Between Users

In-app chat is provided to facilitate genuine, item-related communication between buyers and sellers. You agree not to use the chat (or any other communication channel on the Platform) to:

Share or request personal data, financial information, OTPs, passwords or identity documents beyond what is strictly necessary and lawful for the transaction.
Send spam, advertising for unrelated products or services, phishing links or malicious software.
Harass, threaten, defame, stalk or otherwise harm another user.
Circumvent the Platform to defraud another user or to evade applicable fees on managed-resale transactions or to solicit users for unrelated services.
Transmit viruses, malware, code, files or content designed to disrupt, damage, intercept or gain unauthorised access to any system, data or account.
Conduct phishing, fake enquiries or any other fraudulent activity.

Event Kabaadi may monitor, review and/or moderate in-app communications for fraud-prevention, user safety, Platform integrity and legal compliance purposes, in line with the Privacy Policy and applicable laws.

6. Offline Transactions and Risk

Because payments and item handover for user-listed inventory occur off-platform, you accept the following:

Event Kabaadi has no visibility into, control over and bears no responsibility for, the payment method, payment timing or settlement between you and the other party.
Inspect the item physically before transferring funds. Prefer secure, traceable payment methods. Avoid sending advance payments to unverified sellers.
Event Kabaadi does not offer escrow, buyer protection, seller protection, insurance, logistics, installation or refund guarantees for user-listed inventory.
You are solely responsible for verifying the identity, capacity and authority of the party you transact with and documenting the transaction.
Event Kabaadi is not responsible for loss, damage, injury, non-payment, non-delivery, fraud, theft or disputes arising from such offline transactions.

7. Managed-Resale Transactions

Items marked as "Sold by Event Kabaadi" (or similar) are sold by us as principal. For these transactions:

The price displayed at checkout (or in our written quotation) is the binding price.
Title and risk pass to the buyer upon physical delivery and acceptance of the item.
Returns, refunds and warranties (if any) are governed by the specific sale terms displayed on or alongside the relevant listing or quotation. In the absence of specific written terms, used goods are sold on an "as-is, where-is" basis.
Nothing in this section is intended to limit any non-excludable rights you may have under the Consumer Protection Act, 2019.

8. Fees and Pricing

Browsing, account creation and posting standard listings on the Platform are free of charge. We may introduce optional paid features, premium placement, verification badges or transaction fees for managed-resale items in the future. Any such fee will be clearly disclosed before you commit to the relevant feature or transaction, shall be non-refundable and exclusive of any applicable taxes. Event Kabaadi reserves the right to change the fee structure on prospective notice.

9. Intellectual Property

The Platform, including its software, design, logos, trademarks, text, graphics and aggregated data, is owned by Event Kabaadi or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You receive a limited, non-exclusive, non-transferable, non-sub-licensable, revocable licence to use the Platform solely for personal, non-commercial purposes (or, in the case of business sellers, for the conduct of legitimate transactions on the Platform in accordance with these Terms). You may not:

Copy, reproduce, modify, distribute, create derivative works from, sell or lease any part of the Platform.
Reverse engineer or attempt to extract source code, algorithm or underlying structure.
Use bots, scrapers, data mining tools or any automated means to access, monitor, copy, train models on or interfere with the Platform, except for general-purpose search engine crawlers that comply with our robots.txt and all applicable laws.

By posting content on the Platform (including listings, photographs, descriptions and reviews), you grant Event Kabaadi a worldwide, royalty-free, non-exclusive, transferable, sub-licensable licence to host, store, reproduce, modify (for technical purposes such as resizing), display and distribute that content for the purpose of operating and promoting the Platform. You represent and warrant that you own or have all the necessary rights and permissions to that content and that our use of it under this licence will not violate any law or third-party right.

You waive, and agree not to assert, any moral rights or similar rights in user content to the maximum extent permitted by law, and you acknowledge that we may remove or disable access to user content without any obligation to preserve or return it.

10. Intermediary Status and User-Generated Content

In its role as an intermediary for user-listed inventory, Event Kabaadi does not pre-screen all listings and does not initiate, select or modify the content of user transmissions. We rely on the safe-harbour protections available to intermediaries under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended from time to time).

We will act, in accordance with applicable law, on actual knowledge received through a court order, government direction or other legally recognised notice, on credible reports of unlawful content. Notices of allegedly infringing or unlawful listings should be sent to our Grievance Officer (Section 17) and must include sufficient information to identify the listing and the user, the basis of the complaint, supporting materials, your contact details and verification of your identity. We may remove or disable access to content without admitting liability and may preserve records or share information with authorities where required or permitted by law.

Event Kabaadi may use automated and manual tools to detect, restrict or remove suspicious content, but such measures do not create a duty to monitor or assume responsibility for user content.

11. Reviews, Ratings and Reports

Reviews and ratings must reflect genuine, personal experience and must not be incentivised, fabricated or written by a competitor.
Do not post reviews that are defamatory, obscene or that contain personal data of another individual.
You may use the in-app "Report" feature to flag listings, profiles or messages that violate these Terms. We will review reports and may remove content or suspend accounts based on our investigation.
We do not endorse user reviews, ratings or reports and are not responsible for their accuracy. We may display or remove them to protect users and Platform integrity.

12. Suspension and Termination

Without prejudice to any other right or remedy, Event Kabaadi may, with or without notice where permitted by applicable law, suspend, restrict or terminate your access to all or part of the Platform, remove content or listings, block devices or mobile numbers, or refuse future access, if:

We have reasonable grounds to believe that you have breached these Terms, the Privacy Policy or any applicable law.
Your account or listings are connected to fraud, impersonation, identity theft or is flagged as spam by other users.
We are required to do so by a court, regulator or law enforcement authority.
Continued operation of the account poses a security, legal or reputational risk to us, the Platform or its users.
You misuse communications, ratings, reports, listings or any feature of the Platform.

You may deactivate your account at any time by writing to us at the support email below. Suspension or termination does not affect rights or obligations that, by their nature, are intended to survive (including ownership provisions, indemnities, disclaimers, limitations of liability and governing law). We may retain records after termination as required or permitted by law and the Privacy Policy.

13. Disclaimers

Except where Event Kabaadi acts as the seller of record (managed-resale), the Platform and all user-listed inventory, user content, communications, ratings, reports and related services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Event Kabaadi disclaims all warranties, express or implied, including warranties of merchantability, title, fitness for a particular purpose, non-infringement, accuracy, availability and security. We do not warrant that listings are accurate or lawful, that users are who they claim to be, that the Platform will be uninterrupted or error-free, that items are genuine, safe, available, suitable or free from defects, that communications are reliable or that any defects will be corrected. We will not be a party to, or in any way be responsible for, monitoring any transaction between you and/or other users. We will not be liable for any kind of loss/damage to the buyer or seller.

We do not guarantee specific relief or specific performance of any contract/terms that a buyer and seller on the Platform enter into between themselves.

We do not warrant or assume responsibility for any product or service featured in any banner or other advertising on the Platform.

We operate as an intermediary to facilitate exchange of information between users. We neither promote nor engage in unfair trade practices, nor can we be held liable for any deficiency in services as defined under the Consumer Protection Act, 2019. Any grievances regarding unfair trade practices or deficiency in services pertaining to the listings on our Platform should be addressed directly with the owner of the respective listings.

14. Limitation of Liability

To the maximum extent permitted by law, Event Kabaadi, its directors, employees and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or business opportunity, arising out of or in connection with your use of the Platform and associated matters thereof, or any user-to-user transaction. Our aggregate liability for direct damages, regardless of the form of action and whether in contract, tort or otherwise, is limited to the greater of (a) the total fees you have paid to Event Kabaadi in the twelve (12) months immediately preceding the event giving rise to liability, or (b) INR 5,000 (Indian Rupees Five Thousand). Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

15. Indemnity

You agree to defend, indemnify and hold harmless Event Kabaadi, its officers, directors, employees and agents from and against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to: (a) your access and/or use of the Platform; (b) your breach of these Terms or the Privacy Policy; (c) any content you post or transmit; (d) your violation of any law or third-party right; (e) any user-to-user transaction in which you are involved; (f) fraud, misrepresentation, negligence or wilful misconduct by you or anyone using your account.

16. Governing Law and Dispute Resolution

These Terms are governed by, and shall be construed in accordance with, the laws of India. Subject to the dispute-resolution process below, the courts at Panaji, Goa shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with these Terms.

Before initiating any judicial proceeding, you agree to first raise the issue with our Grievance Officer in good faith. If the dispute is not resolved within thirty (30) days of being raised, either party may refer the dispute to arbitration before a sole arbitrator appointed by Event Kabaadi in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Panaji, Goa, and the language shall be English. The arbitrator's award shall be final and binding.

We will acknowledge grievances within twenty four (24) hours and resolve them within fifteen (15) days of receipt, except where law requires a shorter timeframe.

18. Changes to the Terms

We may revise these Terms from time to time. The updated version will be posted on the Platform with a revised "Effective Date". Where changes are material, we will provide a more prominent notice where practicable. Your continued use of the Platform after the changes take effect signifies your acceptance of the revised Terms; if you do not agree, you must stop using the Platform. We may also modify, suspend or discontinue any feature, listing category, etc. on the Platform, on prospective notice where practicable, without liability except as required by law.

19. Miscellaneous

Severability: if any provision is held to be invalid or unenforceable, the remaining provisions remain in full force.
No waiver: failure to enforce any provision is not a waiver of our right to do so later.
Assignment: you may not assign these Terms without our prior written consent. We may assign them in connection with a corporate transaction.
Entire agreement: these Terms, together with the Privacy Policy and any feature-specific terms displayed on the Platform, constitute the entire agreement between you and Event Kabaadi in relation to the Platform.
Notices: notices to Event Kabaadi must be sent to the support email above; notices to you will be sent to the mobile number or email registered on your account.
Force majeure: Event Kabaadi is not liable for delay or failure caused by events beyond its reasonable control, including outages, cyber incidents, strikes, shortages, acts of God, epidemics, government actions, war, terrorism or failures of third-party networks and payment systems.
Relationship: These Terms do not create any partnership, joint venture, employment, franchise, agency, fiduciary or brokerage relationship between you and Event Kabaadi.
Survival: provisions that, by their nature, are intended to survive including disclaimers, limitations of liability, indemnity, dispute resolution, governing law and any accrued rights, shall survive termination or expiry.
